Please read these Terms and Conditions carefully before using tactiq.co services. This document explains your rights and obligations as a user, as well as Tactiq’s rights and responsibilities as a service provider.

1. Acceptance of Terms

By accessing, registering for, or using the website, application, or other services provided by Tactiq (“Services”), you represent that:

  • You have read, understood, and agreed to these Terms and Conditions; and
  • You are authorized and have the legal capacity to enter into a binding agreement with Tactiq.

If you are using the Services on behalf of an organization or other entity, you represent that you have the authority to bind that organization to these terms.

2. Definition & Interpretation

In these Terms and Conditions, unless the context otherwise requires:

  • “Tactiq”, “we”, ‘us’, “the provider” refers to the entity that owns and manages the tactiq.co website.
  • “User”, “you” means the individual or legal entity accessing/using the Service.
  • “Account” means a user account created to access certain features.
  • “User Content” is all information, text, images, audio, video, digital assets, and other material uploaded or published by users.

 

Section titles are for navigation purposes only and do not affect interpretation.

3. Eligibility

This service is only available to individuals who meet the local legal age requirements (minimum 13 years old or the applicable age limit in your jurisdiction). If you are under the required age, you are prohibited from using the Service unless you have the consent of a parent/guardian in accordance with applicable law.

We reserve the right to refuse registration or use by individuals or entities prohibited by law.

4. Registration & User Accounts

4.1 Account Creation

  • You may be required to create an Account by providing accurate and correct information (e.g., name, email, password). You are responsible for the accuracy of such information.

4.2 Credential Confidentiality

  • You are responsible for keeping your account credentials (username and password) confidential and for all activities that occur under your account. Notify us immediately if you suspect any unauthorized access.

4.3 Suspension & Termination of Account

  • We reserve the right to suspend, restrict, or terminate your account if we suspect violation of these Terms or for security reasons.

5. Services Provided

5.1 Service Description

  • The Services may include access to content, collaboration tools, third-party integrations, AI features, and/or a digital asset marketplace.

5.2 Modification of Services

  • We may add, modify, or discontinue features with or without notice and are not liable if such changes affect your experience.

5.3 Free & Paid Versions

  • Certain features may be offered under freemium or subscription models. Pricing and features will be detailed on the pricing page or in package descriptions.

6. User Content

6.1 Ownership

  • You retain ownership of your User Content. By uploading content through the Services, you grant Tactiq a non-exclusive, royalty-free, worldwide license to display, store, process, and use that content to provide the Services.

6.2 Your Warranties

  • You warrant that you have the rights to upload and license the User Content and that it does not infringe any third-party rights or laws.

6.3 Moderation & Removal

  • Tactiq may modify, reject, remove, or disable access to User Content deemed to violate the Terms, be harmful, or illegal, without prior notice.

6.4 Third-Party Content

  • If you publish or distribute third-party content, you are responsible for obtaining the necessary permissions.

7. Acceptable Use & Prohibited Conduct

You agree not to use the Services to:

  • Engage in illegal activities, infringe IP rights, or copy materials without permission

  • Spread malware, viruses, or harmful code

  • Conduct fraud, money laundering, or other criminal activities

  • Send spam, unsolicited ads, or unauthorized commercialization

  • Access another’s account without permission or breach our security systems

  • Violation may result in suspension, account termination, or legal action.

8. Pricing, Payments & Subscriptions

8.1 Pricing Changes

  • Service pricing is specified on the pricing page. We reserve the right to change pricing with prior notice.

8.2 Payment Methods

  • Payment may be via available methods (e.g., credit card, bank transfer, payment gateway). Users are responsible for taxes or additional fees.

8.3 Free Trials & Auto-Renewal

  • Free trials, if offered, come with their own conditions. Subscriptions auto-renew unless canceled prior to renewal.

8.4 Cancellation & Refunds

  • Cancellation and refund terms are detailed in the payment policy. Refunds for digital goods/assets are generally not available unless due to technical failure or fraud.

8.5 Failed Payments

  • If a payment fails, access to paid features may be restricted until payment is successful.

9. Intellectual Property Rights

9.1 Tactiq’s Rights

  • All trademarks, logos, designs, software, and content provided by Tactiq are protected by IP laws.

9.2 Limited License to Users

  • You are granted a limited, non-exclusive, non-transferable license to use the Services under these Terms.

9.3 Copyright Complaints

  • If you believe there’s copyright infringement, contact our legal team with details. We may remove the infringing content or suspend repeat offenders.

10. Confidentiality & User Data

Our Privacy Policy details how we collect, use, and safeguard your personal data. By using the Services, you also agree to those terms.

11. Warranties & Disclaimers

11.1 No Warranties

  • Services are provided “AS IS” and “AS AVAILABLE.” Tactiq makes no express or implied warranties regarding accuracy, completeness, or usefulness of the content.

11.2 No Business/Investment Guarantee

  • Tactiq does not guarantee the suitability of the Services for commercial or investment purposes, including digital assets.

12. Limitation of Liability

To the maximum legal extent, Tactiq is not liable for indirect, incidental, special, consequential damages arising from your use or inability to use the Services. Tactiq’s total liability is capped at the amount you paid in the last 12 months (or a minimum amount as per law)

13. Indemnification

You agree to indemnify, defend, and hold harmless Tactiq, its affiliates, officers, and employees from losses, liabilities, claims, and costs (including legal fees) arising from your violation of these Terms, legal breaches, or third-party content claims.

14. Termination & Suspension

14.1 By User

  • You may delete your account following the procedures within the Services.

14.2 By Tactiq

  • Tactiq may suspend or terminate account access due to violations, abuse, or for security/operational reasons.

14.3 Post-Termination Effects

  • Upon termination, your access to data or User Content may be removed or unavailable. Some information may be retained per the Privacy Policy or legal obligations.

15. Force Majeure

Tactiq is not liable for delays or failures due to events beyond its control (e.g., natural disasters, war, strikes, network failures). Obligations are suspended during such events.

16. Changes to the Terms

We may update these Terms from time to time. Changes become effective when the “effective date” is updated, and may be notified via email or a banner. Continuing to use the Services after changes constitutes acceptance.

17. Governing Law & Dispute Resolution

These Terms are governed by Indonesian law. Disputes will first be resolved by amicable negotiation; if unresolved, they may be submitted to court or arbitration under applicable law and jurisdiction determined by Tactiq.

18. Notices

All official notices required under these Terms must be sent via email to Tactiq’s official address or your registered email. Notices are deemed received 48 hours after sending unless proven otherwise.

19. Miscellaneous

19.1 Severability

  • If any provision is deemed void or unenforceable, other provisions remain in effect.

19.2 No Waiver

  • Tactiq’s failure to enforce a right isn’t a waiver of that right.

19.3 Assignment

  • Tactiq may assign or transfer its rights and obligations; users may not assign without written consent.

19.4 Entire Agreement

  • These Terms, the Privacy Policy, and related documents comprise the entire agreement between you and Tactiq regarding the Services.

21. AI & Digital Asset Usage Policy

21.1 Introduction
Tactiq may offer AI-powered features and support interactions or transactions involving digital assets (e.g., NFTs, digital licenses, token metadata). This section governs usage, ownership, responsibilities, and risks related to AI and digital assets.
21.2 Definitions

  • AI / AI Model: systems using machine learning or models to generate output.

  • AI Content: output generated by AI such as text, images, audio, or code.

  • Digital Asset: digital representations of value or rights (e.g., NFTs, licenses, metadata tokens, licensed digital files).

21.3 AI Use — General Policy

  • AI features assist users in content creation or process enhancement. Users are responsible for the AI output usage.

  • AI may not be used for illegal acts, privacy violations, impersonation, unauthorized deepfakes, or fraud.

  • If you publish AI-generated content, you should disclose its origin (transparency). Tactiq may enforce specific labeling requirements.

21.4 Ownership & Licensing of AI Output

  • Unless otherwise stated, AI-generated outputs you create via Tactiq are your property. By creating or uploading such outputs, you grant Tactiq a non-exclusive, worldwide, royalty-free license to display, store, and process them for service provision.

  • If a third-party model was used, use of its output must comply with that model provider’s terms.

21.5 Third-Party Rights

  • You are responsible if AI output or digital assets you upload infringe on third-party rights (copyright, trademarks, privacy, etc.).

  • Tactiq may suspend or remove infringing assets/content until claims are resolved.

21.6 Transactions & Risks of Digital Assets

  • Digital asset transactions are typically final. Users must verify transaction details (e.g., wallet address, metadata, price).

  • Tactiq is not liable for asset value fluctuations, third-party blockchain failures, or user errors causing access loss.

  • Taxes and other obligations arising from transactions are the user’s responsibility.

21.7 Wallets, KYC & Compliance

  • Users are responsible for the security of their personal wallets and addresses. Tactiq is not liable for losses from transfers to incorrect addresses.

  • For certain activities, Tactiq may require identity verification (KYC) and can withhold or seize funds to comply with regulations (e.g., AML/CFT).

21.8 Moderation, Removal & Takedown

  • Tactiq may refuse, remove, or disable listings of digital assets that violate Terms. Users may appeal via designated complaint procedures.

21.9 Telemetry & Data Use for Model Training

  • Tactiq may store AI usage metadata (e.g., prompts, timestamps, output logs) for debugging and service improvement.

  • If user data will be used to train internal models, Tactiq will obtain explicit consent or provide opt-out options as per privacy policies.

21.10 Specific Limitations & Disclaimers

  • AI outputs are provided without warranties of accuracy or non-infringement. Tactiq is not liable for commercial decisions based on AI output or traded digital asset values.

21.11 Dispute Resolution for Digital Assets

  • Disputes related to digital asset transactions will first go through internal mediation. If unresolved, they will follow the procedures in clause 18.
